This Biometric Data Privacy Policy describes how G Motion Rentals Inc and our third-party identity verification provider (currently Stripe Identity, operated by Stripe, Inc.) collect, use, store, and dispose of biometric data in connection with our identity verification feature. This policy is intended to comply with the Illinois Biometric Information Privacy Act, 740 ILCS § 14/1 et seq. ("BIPA"), the Texas Capture or Use of Biometric Identifiers Act, Tex. Bus. & Com. Code Ann. § 503.001 ("CUBI"), Washington H.B. 1493, RCW 19.375 ("WA HB 1493"), and any other applicable state law (collectively, "Biometric Data Privacy Laws").
"Biometric identifier" means data derived from physical or behavioral characteristics that can be used to identify a specific individual — including, in the context of our service, facial geometry derived from a selfie photograph and a photograph or scan of a driver's license. "Biometric information" means any information, regardless of how it is captured, converted, stored, or shared, based on a biometric identifier used to identify an individual. "Biometric identifier" does not include photographs, demographic data, or physical descriptions such as height, weight, hair color, or eye color, except to the extent any such material is converted into biometric information used to identify an individual. Collectively, biometric identifiers and biometric information are referred to in this policy as "biometric data."
We collect biometric data only for the purpose of identity verification before a renter is permitted to book a vehicle, and as a fraud prevention measure if we have reason to believe an account or transaction may involve fraud, identity theft, or misuse of stolen identification. Biometric data is also used to confirm that the person who booked a trip is the same person who picks up the vehicle. We do not use biometric data for marketing, advertising, profiling, or any other purpose unrelated to identity verification and fraud prevention.
Before any biometric data is collected, derived, or generated from or about you, we will provide notice in writing (typically on the verification page within our platform) describing the type of biometric data being collected and the purpose for which it is being collected, and we will obtain your written consent. By initiating an identity verification through our platform, you affirmatively consent to the collection, use, storage, and disposal of your biometric data as described in this policy.
We do not sell, lease, trade, or otherwise profit from your biometric data. We disclose biometric data only as necessary to facilitate the identity verification service: namely, to our verification provider (Stripe Identity) and to ourselves. We do not disclose biometric data to any other third party unless: (a) you consent to the disclosure; (b) the disclosure is required by federal, state, or local law, including a subpoena, court order, or search warrant; (c) the disclosure is required to complete a financial transaction you have authorized; or (d) the disclosure is required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction.
Biometric data is stored by our verification provider (Stripe Identity) using industry-standard security measures, including encryption at rest and in transit, role-based access controls, and audit logging. We store the result of the verification (verified, failed, or pending) and the verification session ID in our database. We do not store the underlying biometric data on our own infrastructure; that data resides with our verification provider.
We will permanently destroy your biometric data when the initial purpose for collecting it has been satisfied or within three (3) years of your last interaction with G Motion Rentals Inc, whichever occurs first. "Last interaction" includes the date of your last completed trip, your last platform login, or your last response to our communications. You may also request earlier deletion by emailing gmotionrentals@gmail.com with the subject "Biometric Data Deletion." We will instruct our verification provider to delete the corresponding biometric data and confirm completion within 30 days, unless we are legally required to retain the data for an ongoing investigation or claim.
You may request information about the categories of biometric data we have collected about you, the source from which it was collected, the purposes for which it was collected, and any third party to whom we have disclosed it. You may request a copy of your biometric data, you may request correction of inaccurate biometric data, and you may request deletion of biometric data. You may also withdraw your consent at any time — note that doing so will end your ability to use parts of our platform that depend on identity verification (including booking new trips).
